CRUMP WILL BE DEPOSED – 5th DCA Decision – O’Mara Wins – Judge Nelson Reversed…

The appellate court ruling is short; the text and a link are provided at the re-blogged site. The points made by the court in favor of Mr. Zimmerman seem elementary as well as correct, based solely on the little bit of criminal law experience I enjoyed many, many years ago as an Army JAG officer.

Next, it will be interesting to see what sort of mess the trial judge makes in ruling (a) on objections to deposition questions and (b) on what use, if any, can made of them at trial – if the prosecution produces “witness 8” to testify. It may not. The Martin attorneys have devoted their efforts largely to convincing the media – and hence potentially the jury – that Mr. Zimmerman is guilty. The prosecution seem to have taken a similar tack.
